Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Claim Saathi Technologies Private Limited (CIN U62090MR2026PTC477714) ("HomeBuyerSaathi", "we", "us"), governing your access to and use of our website and services (the "Service"). By creating an account or using the Service, you confirm you have read, understood and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding contract under Indian law to use the Service. By using it, you represent that you meet these requirements and that the information you provide is accurate.
2. What HomeBuyerSaathi is (and isn't)
HomeBuyerSaathi provides software tools, information and document templates to help home buyers check projects, understand risks, organise their purchase and act if a project is delayed — from booking to possession. We are a technology company, not a law firm, financial adviser, broker or valuer. We do not provide legal, financial or investment advice, do not represent you before any authority or tribunal, and are not a party to any transaction between you and a builder.
3. No advice; no guarantee of outcome
Our Safety Scores, reports, calculations, checklists and generated drafts are interpretive aids built from public data and the inputs you provide — for information and convenience only. They are estimates, not a verdict on any promoter, and not a guarantee of any result. The final relief in any matter is decided solely by the competent Authority or Tribunal. Always have a qualified advocate review any document before you file or rely on it, and independently verify any figure before you act.
4. Data sources & accuracy
Project and builder information is derived from publicly available MahaRERA / RERA records and the details you enter. Public records may be incomplete, delayed, or inaccurate. We do not warrant that any data is current, complete or error-free, and you should verify important details against the official MahaRERA portal and your own documents.
5. Your account
You sign in using your mobile number and a one-time code. You are responsible for keeping access to your number and account secure, and for all activity under your account. One person should maintain one account. You can delete your account and data at any time from Account & privacy.
6. Acceptable use
You agree to use the Service lawfully and not to:
- upload or post content that is unlawful, defamatory, misleading, infringing, obscene or harmful, or that violates another person's rights or privacy;
- impersonate any person, or misrepresent your affiliation with a project or builder;
- scrape, reverse-engineer, overload, disrupt, or attempt unauthorised access to the Service or its data;
- use the Service to send spam, or for any unlawful, fraudulent or commercial purpose we haven't authorised.
We may remove content or suspend accounts that breach these Terms.
7. Community content
The Service includes verified project communities where users share updates, documents and polls. You are solely responsible for what you post, and you must not post another person's private information without consent. We are an intermediary hosting user content and do not endorse it. To report content that breaches these Terms, contact our Grievance Officer (Section 14) and we will act as required by law.
8. Your content & documents
You retain ownership of the documents and information you upload. You grant us a limited, revocable licence to store and process them only to provide the features you request (for example, reading a document to build your report or case file). We do not sell your content or share your case details with builders or brokers. See the Privacy Policy for how we handle your data.
9. Our intellectual property
The Service, including its software, design, text, Safety Score methodology, report formats and the "HomeBuyerSaathi" name and logo, is owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable right to use the Service for your own home-buying needs. You may not copy, resell or commercially exploit any part of it without our written permission.
10. Payments, pricing & refunds
Some features (such as the Detailed Project Report and Saathi Plus) are paid, at the prices shown at the time of purchase (inclusive of applicable taxes). Payments are processed by our payment partner (Razorpay); we do not store your full card or bank details.
Refunds: because paid reports are generated on demand and delivered digitally, payments are non-refundable once the report has been generated or accessed, or the subscription has been used — except where we fail to deliver the service, or a refund is required under applicable law. If you believe there is a genuine issue (such as a failed delivery or a duplicate charge), contact us within 7 days at support@homebuyersaathi.com. 11. Third-party services
The Service relies on third-party providers (for example, Razorpay for payments and WhatsApp for messaging) and may link to third-party sites such as the MahaRERA portal. We are not responsible for third-party services or content, which are governed by their own terms.
12. Disclaimers & limitation of liability
The Service is provided on an "as is" and "as available" basis, without warranties of any kind. To the maximum extent permitted by law, Claim Saathi Technologies Private Limited shall not be liable for any indirect, incidental, special or consequential loss, or for any decision you make based on the Service. Our total aggregate liability for any claim is limited to the amount you paid us for the Service in the twelve months before the claim (or ₹1,000 if you paid nothing).
13. Indemnity
You agree to indemnify and hold us harmless from any claim or demand arising out of your breach of these Terms, your misuse of the Service, or content you upload or post.
14. Grievances (IT Rules) & contact
In accordance with applicable law, including the Information Technology Act, 2000 and rules thereunder, you may raise a complaint about the Service or any content with our Grievance Officer:

15. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and indemnity) will continue to apply.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date, and where changes are material we will take reasonable steps to notify you. Continued use after changes take effect constitutes acceptance of the revised Terms.
17. Governing law & jurisdiction
These Terms are governed by the laws of India. Subject to any right you have to approach a consumer forum, the courts at our registered office location shall have exclusive jurisdiction over any dispute arising from these Terms or the Service.
